Terms of Service
These Terms govern access to Biridea Mail’s hosted business email, administration, domain, DNS, webmail and mobile services. Please read them before creating an account, starting a trial, making a payment or buying a domain.
1. Agreement and eligibility
These Terms are an agreement between you and Biridea Marketing Agency, operator of Biridea Mail in Azerbaijan (VÖEN 3103587002). “You” includes the customer account owner, the organization it represents and each person using a mailbox or administrative account under its authority.
By creating an account, verifying a phone number, using a mailbox, starting a trial, purchasing or renewing a domain, or paying for the service, you accept these Terms and our Privacy Policy. If you act for an organization, you confirm that you have authority to bind it and administer its domains and mailboxes.
You must be at least 18 years old and legally able to contract. The service is intended for legitimate business and professional communication.
2. What Biridea Mail provides
Depending on your plan, configuration and device, the service may include:
- hosted mailboxes on customer-owned or customer-purchased domains using IMAP, SMTP, webmail and a mobile client;
- an administration console for domains, DNS checks, mailboxes, plans, subscriptions, billing and tenant access;
- mail folders, search, drafts, sending, attachments, contacts, signatures, templates, labels, threads, block lists, spam reporting and storage cleanup;
- server-side filters, forwarding, read/star/label actions and vacation auto-replies through ManageSieve;
- mail security and deliverability configuration including TLS, SPF, DKIM and DMARC guidance or managed records;
- optional authenticator-based two-factor authentication, recovery codes and mobile push notifications;
- connection of an existing domain, registration and renewal of eligible domains, DNS editing for domains managed through us, and registrar fulfilment; and
- abuse controls, quota reporting, payment handling and reasonable support.
Features, plan limits, supported domain extensions, quotas, pricing and provider availability may change. A plan grants a limited right to use the current service; it does not transfer Biridea’s software or infrastructure to you.
3. Accounts, mailboxes and security
- You must provide accurate, current information and maintain control of the verified phone number, domain, payment method and recovery mechanisms associated with your account.
- The customer account owner is responsible for all domains and mailboxes it creates, the people it authorizes, their conduct, and promptly suspending former or unauthorized users.
- You must keep passwords, authenticator seeds, recovery codes, bearer tokens and devices confidential. Do not share a mailbox credential with Biridea support unless we provide a specifically authorized secure procedure.
- You must notify us promptly of suspected compromise, unauthorized domain/DNS changes, abuse or billing errors and cooperate with reasonable security steps.
- Administrative impersonation or support access may be used by specifically authorized Biridea personnel when needed to provide requested support, investigate abuse, secure the service or comply with law.
You are responsible for maintaining any copies or exports your business requires. Mailbox deletion, permanent message deletion and storage cleanup can be irreversible.
4. Acceptable use and shared-IP protection
You may not use the service to:
- send unsolicited bulk or commercial email, purchased lists, phishing, malware, fraudulent messages, deceptive headers or content that violates applicable anti-spam, privacy, intellectual-property or other law;
- harass, threaten, defame, exploit, impersonate or unlawfully monitor another person;
- host or transmit illegal content, stolen credentials, malicious code or material that infringes third-party rights;
- probe, bypass or interfere with authentication, quotas, rate limits, spam controls, account isolation, payment controls or system security;
- resell, sublicense or provide the service outside your organization without our written permission;
- damage Biridea’s or another customer’s sending reputation, IP reputation, infrastructure or service availability; or
- use a domain, sender identity or registrant information you do not have authority to use.
We may automatically score outbound content, cap recipients, rate-limit mailboxes, limit trial sends, reject a message, quarantine activity, require verification, suspend a mailbox or account, or preserve evidence where we reasonably suspect abuse or compromise. These controls may produce false positives. We are not required to deliver mail that violates a limit or policy.
You are responsible for the legality and accuracy of your messages, contacts, forwarding, auto-replies, rules and domain use, and for obtaining any consent required from recipients or mailbox users.
5. Existing domains, purchases and renewals
Connecting a domain you already control
You confirm that you own or are authorized to administer every connected domain. DNS changes can interrupt websites, email and other services if applied incorrectly. Biridea may provide checks and managed-record safeguards, but you must review records and maintain access to the domain registrar. DNS propagation and third-party resolvers are outside our control.
Buying a domain through Biridea
- Search results are not a reservation or guarantee. A domain remains subject to registry availability and rules until the registrar confirms completed registration.
- You must check the complete spelling, extension, registration term, price and registrant details before payment. You authorize us and our registrar to submit those details and register the domain for you.
- You must provide complete, truthful registrant contact data and keep it current. False, incomplete or unverified data can cause suspension, transfer restrictions or deletion by the registrar or registry.
- Registration gives the registrant a time-limited contractual right to use the domain, not permanent ownership. It remains subject to registry, registrar, ICANN, dispute-resolution, trademark, court and governmental rules.
- Some registrant data may be disclosed through WHOIS/RDAP or to authorized requestors as required by applicable registration policy or law.
No cancellation or refund after submission
All domain registration and renewal sales are final once the order has been submitted to the registrar or completed. Domain fees are non-refundable for typographical errors, unwanted names, unused time, early transfer, account cancellation, later ineligibility, registry suspension, a lost dispute, inability to use a name as intended, or failure to update contact information. We may reject a cancellation request even if a registry happens to offer Biridea a deletion grace period; any such registry mechanism is discretionary and is not promised to you.
If payment succeeds but registration or renewal cannot be fulfilled, we may retry, correct a remediable error, offer a reasonably equivalent solution, or refund the amount paid for that failed domain order. We are not responsible for lost business, brand value, traffic, email or opportunities caused by an unavailable or failed domain. Nothing in this clause excludes a remedy that cannot lawfully be excluded.
Expiry and automatic renewal
Where auto-renew is enabled, you authorize Biridea to charge the saved payment method and submit renewal during the renewal window. Renewal is not guaranteed: payment, provider, registry, contact-verification or technical failure may prevent it. You remain responsible for monitoring expiry, keeping payment/contact data current and renewing in time.
An expired domain may stop resolving, enter grace or redemption status, incur additional recovery fees, be deleted or become available to another person. Biridea does not guarantee recovery after expiry and is not liable for loss caused by expiry or failed renewal to the maximum extent permitted by law.
6. Plans, trials, billing, cancellation and refunds
- Current prices, taxes (if any), limits and billing periods are shown before checkout. Monthly plans are charged monthly. Yearly plans are charged for the full year upfront even where a monthly-equivalent price is displayed.
- Eligible plans may include a five-day trial; plans identified as having no trial require payment before access. Trial access and send caps may be limited to prevent abuse.
- By completing checkout, you authorize epoint to process the payment and provide a saved-card token, and authorize Biridea to charge that token for automatic subscription and eligible domain renewals until cancelled or disabled.
- You may request cancellation for the end of the current paid period. Pausing stops renewals and suspends mailbox access. We keep your mailboxes and domains for 90 days after a pause, unpaid (past-due) status, or cancellation, then permanently delete them. Resume or pay within that window to restore access. Unless stated otherwise, cancellation stops future renewal and does not erase amounts already due.
- Failed or disputed payments may cause a subscription to become past due and mailboxes to be suspended. Restoring payment may restore access, but queued or rejected mail during suspension may not be recoverable. If a past-due, paused or canceled subscription is not restored within 90 days, mailboxes and domains are permanently deleted.
- Gifted or promotional access has no cash value and may be subject to its stated duration and limits.
Except where mandatory law requires otherwise, subscription fees are non-refundable once a paid period begins, including for partial periods, unused service, pause, downgrade, suspension for breach or cancellation before period end. Domain orders are governed by the stricter final-sale rule in Section 5. Duplicate or demonstrably unauthorized charges and charges for a service Biridea fails to provide will be investigated and remedied as required by law.
Chargebacks do not cancel these Terms or domain obligations. You should contact us first so we can investigate. You are responsible for bank, currency conversion, tax and third-party charges not imposed by Biridea.
7. Customer data, privacy and intellectual property
You retain rights you already hold in your domains, messages, contacts and other content. You grant Biridea and its providers a limited, non-exclusive right to host, copy, transmit, render, scan, cache, modify for technical formatting, back up and otherwise process that content only as reasonably necessary to provide, secure, support and improve the service, enforce these Terms and comply with law.
You confirm that you have the necessary rights and notices for all content and personal information you submit or cause us to process, including employee mailbox data, contacts, forwarding addresses and domain registrant details. You must not submit content that unlawfully infringes another person’s privacy, confidentiality or intellectual property.
Biridea and its licensors own the service software, interface, documentation, branding and underlying technology. No right is granted except the limited service access expressly described here. Feedback may be used without restriction or payment, provided we do not publicly identify you without permission.

8. Availability, changes and support
We aim to provide a reliable service but do not promise uninterrupted, error-free or permanent availability. Maintenance, attacks, provider outages, internet/DNS failures, mail-server behavior, registry systems, payment systems, device platforms, force majeure and other events may interrupt features.
We may add, remove, limit or replace features; modify plan limits; require updates; change infrastructure or providers; or discontinue the service. Where commercially reasonable, we will give notice of material adverse changes. Emergency security and abuse actions may occur without advance notice.
Support is provided on a reasonable-efforts basis. Statements such as “managed”, “secure”, “high security”, “spam protection” or “deliverability” describe product goals and controls, not absolute warranties or guaranteed outcomes.
9. Service and delivery disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available”. Biridea disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, uninterrupted availability, data preservation and error-free operation.
We do not guarantee that:
- email will be delivered, received on time, accepted, kept out of spam, free from malware, or displayed consistently by every client;
- SPF, DKIM, DMARC, rDNS, spam controls or warm-up practices will produce a particular reputation or inbox-placement result;
- filters, forwarding, auto-replies, search, threading, labels, push notifications, remote images or third-party clients will behave exactly as expected;
- a domain will remain available, renewable, transferable, recoverable, undisputed or suitable for your intended brand or activity;
- third-party services, including registrars, registries, epoint, SMS, push, DNS, hosting or internet providers, will remain available or unchanged; or
- cached, deleted, expired, suspended or corrupted data can be recovered.
You are responsible for legal, tax, trademark, security, retention, backup, continuity and compliance decisions. Biridea does not provide legal, accounting or trademark advice.
10. Limitation of liability and indemnity
To the fullest extent permitted by law, Biridea and its owners, personnel, affiliates and providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss; loss of profit, revenue, goodwill, business, opportunity or anticipated savings; loss or corruption of data; email non-delivery; domain expiry or loss; reputational harm; business interruption; or the cost of substitute services, even if advised that such loss is possible.
To the fullest extent permitted by law, Biridea’s total aggregate liability arising from the service or these Terms will not exceed the amount you actually paid Biridea for the affected subscription service during the three months immediately before the event giving rise to the claim. For a claim solely concerning an unfulfilled domain order, the maximum will not exceed the amount paid to Biridea for that specific domain order.
These limitations do not apply to liability that applicable law does not permit us to exclude or limit. No provision removes mandatory consumer or data-protection rights.
You will defend, indemnify and hold Biridea and its personnel harmless from third-party claims, registrar or registry action, penalties, losses and reasonable costs arising from your content, recipients, spam or unlawful communications, domain choice or registrant data, infringement, account users, breach of these Terms, or violation of law—except to the extent caused by Biridea’s own unlawful conduct. This obligation is subject to any non-waivable limits under applicable law.
11. Suspension and termination
You may stop using the service and cancel future subscription renewal through available account controls. Deleting a domain from the Biridea console does not cancel its registration, produce a refund or necessarily change registrar ownership.
We may reject, suspend, limit or terminate access immediately where reasonably necessary for security, abuse, non-payment, legal or provider requirements, risk to shared infrastructure, inaccurate registrant information, suspected fraud, material breach or harm to another user. We may also terminate a discontinued service with reasonable notice where practicable.
On termination, your right to use the service ends and mailboxes may stop receiving or sending mail. You are responsible for exporting required content and arranging domain/DNS/mail migration before access ends. We may delete service data after termination subject to legal duties, operational retention and backups. Payment, domain, ownership, disclaimer, liability, indemnity, dispute and other provisions that by nature should survive will survive.
12. General terms
Governing law and disputes
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-law principles. Courts with competent jurisdiction in Azerbaijan will have jurisdiction, except where mandatory law grants you another forum or procedure. Before filing a claim, the parties should try in good faith for 30 days to resolve it through written contact.
Changes
We may update these Terms for service, legal, security, provider or business changes. The current version will be posted at this URL with its effective date. Continued use after an update takes effect constitutes acceptance to the extent permitted by law. If you reject a material update, your remedy is to stop use and cancel future renewal; already submitted domain orders and accrued charges remain binding.
Assignment, severability and waiver
You may not assign the agreement without our written consent. Biridea may assign it as part of a merger, restructuring, financing or service transfer. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest remains effective. Failure to enforce a provision is not a waiver.
Entire agreement and priority
These Terms, the Privacy Policy, the checkout/order details and any specific written service agreement form the agreement concerning Biridea Mail. A specific signed agreement controls over conflicting general Terms. Registrar, registry, ICANN, app-store, payment and third-party terms may also apply directly to their services.
